Terms and Conditions

These Terms and Conditions (the "Terms") govern your use of the website located at naturesdreamlandscape.com (the "Site"), your submission of inquiries and service requests through the Site, and your participation in the Nature's Dream Landscape & Tree Service text messaging program. The Site and messaging program are operated by Nature's Dream Landscape & Tree Service ("Nature's Dream," "we," "us," or "our").

By using the Site, you agree to these Terms. Your use of the Site does not, by itself, constitute consent to receive text messages. SMS consent must be provided separately through a clear, voluntary opt-in method.

1. Eligibility and acceptable use

You must be at least 18 years old and legally able to enter into a binding agreement to use the Site or request services. You agree to provide accurate information and to use the Site only for lawful purposes. You may not attempt to interfere with the Site, gain unauthorized access to any system, transmit malicious code, impersonate another person, or use the Site in a way that violates applicable law or the rights of others.

2. Service information, estimates, and contracts

Information on the Site is provided for general informational purposes. Descriptions, photographs, service areas, availability, schedules, and pricing may change. A request for an estimate or appointment is not an acceptance of work and does not create a service contract.

Landscape, tree, irrigation, maintenance, design, installation, and related services are governed by the applicable written proposal, estimate, work order, service agreement, change order, or other contract accepted by Nature's Dream and the customer. If a signed service agreement conflicts with these Terms, the signed service agreement controls with respect to that service.

3. Electronic communications

When you submit a form, send us an email, or otherwise communicate with us electronically, you consent to receive responsive communications through the same channel or another channel you have authorized. Consent to ordinary email or telephone communication does not automatically provide consent for recurring SMS messages.

4. Nature's Dream SMS Program Terms

4.1 Program name and sender

The program is the Nature's Dream Landscape Customer Communications Program. Messages are sent by Nature's Dream Landscape & Tree Service. Our messaging number is +1 (561) 464-3820. Nature's Dream is the party requesting and relying on your consent.

4.2 How you opt in

You may opt in by voluntarily selecting an unchecked SMS consent box on a Nature's Dream form or by another clear method that specifically asks whether you agree to receive the categories of messages described below. The SMS disclosure is presented at or immediately next to the opt-in control. SMS consent is separate from acceptance of general website terms, a request for an estimate, and any purchase or service agreement.

You may also initiate a one-to-one text conversation with Nature's Dream. An inbound message permits us to respond to that specific conversation, but it does not by itself authorize unrelated or ongoing recurring messages.

4.3 Types of messages

If you opt in, messages may include:

• responses to your questions or customer-service requests;
• estimate, consultation, and project follow-ups;
• appointment confirmations, reminders, rescheduling notices, and cancellations;
• crew arrival, service, weather-delay, and schedule updates;
• project, work-order, property-service, and completion updates; and
• account, billing, payment, or other service-related notices.

This SMS program is for Nature's Dream's own customer communications. We do not use it for affiliate marketing, third-party lead generation, or marketing products or services offered by unrelated third parties.

4.4 Message frequency and charges

Message frequency varies based on your requests, appointments, active services, projects, and interactions with us. Message and data rates may apply according to your mobile service plan. Nature's Dream does not charge a separate fee for the SMS program.

4.5 Consent is optional

Your consent to receive SMS messages is not a condition of purchasing any property, goods, or services. You may contact us by telephone at (305) 874-7374 or email at ccare@naturesdreamlandscape.com if you prefer not to use SMS.

4.6 Opting out

You may revoke SMS consent at any time by replying STOP to any message. You may also use a standard opt-out keyword such as STOPALL, UNSUBSCRIBE, CANCEL, END, REVOKE, OPTOUT, or QUIT. After an opt-out request, we may send one confirmation that your request was processed. We will not send additional SMS messages unless you subsequently provide new express consent.

4.8 Mobile information and consent protection

We do not sell, rent, trade, or share your mobile telephone number, SMS opt-in data, or SMS consent with third parties or affiliates for their marketing or promotional purposes. We may disclose this information only to service providers acting on our behalf to operate and support the messaging program, such as our messaging platform and telecommunications providers, when they are contractually or legally required to protect the information, or when disclosure is required by law. SMS opt-in data and consent are not transferred to any third party for its own marketing, lead generation, or promotional use.

4.9 Carrier and delivery terms

Supported carriers may change. Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed. If you change or deactivate your mobile number, you agree to notify us so that the number can be removed from the program.

4.10 Privacy

Our collection and use of personal information are described in our Privacy Policy. The Privacy Policy includes additional protections specific to mobile telephone numbers and SMS consent data.

4.11 Program changes or termination

We may modify or discontinue the SMS program or its features. Any change will not remove your right to opt out, and we will continue to honor valid opt-out requests.

5. User-provided content and information

If you send us text, photographs, plans, property details, reviews, or other materials, you represent that you have the right to provide them. You authorize us to use those materials as reasonably necessary to respond to your request, prepare an estimate, perform contracted services, maintain business records, and comply with law. We will not use customer photographs or testimonials in public marketing without permission where permission is required.

6. Intellectual property

The Site and its original text, graphics, logos, photographs, designs, organization, and other content are owned by or licensed to Nature's Dream and are protected by applicable intellectual-property laws. You may view and print Site content for your personal, noncommercial use. You may not reproduce, distribute, modify, publish, sell, or commercially exploit Site content without our prior written permission.

7. Third-party sites and services

The Site may link to third-party websites or services. Those third parties operate independently, and their own terms and privacy practices apply. A link does not imply that Nature's Dream controls or endorses all content or practices of the third party.

8. Site availability and disclaimer

We work to keep the Site accurate and available, but the Site may contain errors or experience interruptions. To the maximum extent permitted by law, the Site is provided on an "as is" and "as available" basis, without warranties of uninterrupted availability, error-free operation, or fitness for a particular purpose. This Site disclaimer does not limit any express warranty contained in a signed service agreement and does not exclude any warranty that cannot legally be excluded.

9. Limitation of liability

To the maximum extent permitted by law, Nature's Dream will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of or inability to use the Site. Nothing in these Terms limits liability that cannot lawfully be limited. Liability relating to contracted landscape, tree, irrigation, or other services is governed by the applicable signed service agreement and applicable law.

10. Indemnification

You agree to indemnify and hold Nature's Dream harmless from claims, losses, and reasonable expenses arising from your unlawful misuse of the Site, your material violation of these Terms, or content you submit without the necessary rights. This section does not apply to the extent a claim results from Nature's Dream's own negligence, willful misconduct, or violation of law.

11. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Unless a signed agreement requires another lawful forum, legal proceedings concerning these Terms will be brought in a court of competent jurisdiction in Miami-Dade County, Florida.

12. Changes to these Terms

We may update these Terms from time to time. The revised version will be posted on this page with a new effective date. Material changes to the SMS program will not be used to expand the scope of your consent without obtaining any additional consent required by law or industry rules.

13. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. These Terms, together with the Privacy Policy, constitute the agreement governing use of the Site and SMS program. A signed service agreement remains a separate agreement governing the services described in it.
